1. Agreement to Terms

By accessing www.fsfphotography.com or booking services with FSF Photography LLC, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and FSF Photography LLC.

2. Services and Location Access

FSF Photography LLC provides professional photography services. For location-based services (Real Estate, Lifestyle, etc.), the Client is responsible for ensuring that FSF Photography LLC has legal access to the property at the scheduled time. FSF Photography LLC is not responsible for delays or cancellations caused by restricted access to the service address provided.

3. Intellectual Property and Copyright

Pursuant to the Copyright Act, FSF Photography LLC retains the copyright to all images created during our services. Clients are granted a limited, non-exclusive license to use the images for personal or specified commercial use as outlined in their specific service contract. Unauthorized alteration or commercial resale of images is strictly prohibited.

4. Limitation of Liability

To the maximum extent permitted by Florida law, FSF Photography LLC’s total liability for any claim, loss, or damage arising out of our services (including travel to and from service addresses) shall be limited to the total amount paid by the client for said services. We are not liable for indirect, incidental, or consequential damages.

5. Photo Restoration Disclaimer

For photo restoration services, FSF Photography LLC uses professional imaging tools, which may include AI-assisted technology, to enhance or repair images. We do not guarantee that every damaged original can be perfectly restored to its original state.

6. Governing Law and Venue

These Terms and Conditions are governed by the laws of the State of Florida. Any legal action or proceeding related to FSF Photography LLC shall be brought exclusively in the state or federal courts located in Broward County, Florida.

7. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

Property Access and Readiness

• The Client (Realtor or Property Owner) is responsible for ensuring that FSF Photography LLC has legal access to the service address at the scheduled time. This includes providing valid gate codes, lockbox combinations, or ensuring a representative is present.
• Condition: The property must be “photo-ready” upon arrival. FSF Photography LLC does not provide cleaning, staging, or furniture moving services.
• Safety: For the safety of our team and the protection of your property, all pets must be secured in a crate or off-site for the duration of the shoot.
• Dry Run Fee: If the Photographer is unable to access the property within 15 minutes of the scheduled start time, or if the property is not in a condition to be photographed, a $75 fee will be charged, and the session must be rescheduled.

Digital Retouching and AI Disclosure

FSF Photography LLC utilizes professional post-processing techniques and AI-assisted tools (such as generative fill, sky replacement, and digital decluttering) to provide high-quality imagery.

• Permitted Enhancements: Our standard workflow includes “blue sky” replacement for overcast days, grass greening, and the removal of temporary distractions (e.g., a stray garden hose or a trash can).
• Material Defects: In compliance with Florida real estate advertising ethics and truth-in-advertising standards, FSF Photography LLC will not use AI or digital retouching to hide material defects of the property. This includes removing permanent structures, hiding power lines (unless requested for artistic purposes and disclosed), or masking structural damage.
• Client Responsibility: The Client is responsible for reviewing all delivered images to ensure they are a fair and accurate representation of the property before listing them on any MLS or marketing platform.

Liability & Indemnification

The Client agrees to indemnify and hold FSF Photography LLC harmless against any claims, fines, or legal actions resulting from the use of the images in real estate listings, including claims of “misleading advertising” or “trespassing” provided the Photographer was granted access at the service address by the Client.
